in the child sex abuse case against jerry sandusky. >> reporter: penn state officials arrived at court this morning in harrisburg, facing personal charges connected to the jerry sandusky child sex abuse case. they are accused of lying to the grand jury, telling them assistant football coach mike mcqueary did not tell them that he witnessed sandusky having sex with an underage boy in the shower in the locker room. he told prosecutors he first heard noises coming from the shower. he said he looked in the mirror and saw sandusky behind the boy. he then went on to tell the court, quote, i believe jerry was sexually molesting him and having sexual intercourse with him. mcqueary's testimony is also being contradicted by another grand jury witness, a family friend who says on the night of the alleged abuse, mcquary told him he only heard noises. the now assistant football coach now tells prosecutors he was shocked and distraught at what he saw and left the locker room and called his father for advice. after going home to talk to his father, mcquary says his next call was to head coach joe pat

penn state assistant football coach jerry sandusky has left jail after putting up bail money. he was taken into custody yesterday on 12 additional charges of child sex abuse after two new alleged victims came forward. bail was set at $250,000, but sandusky originally had trouble raising the money and spent the night in jail. as a condition of his release, he has to remain at home wearing an electronic monitoring device. he was first charged last month with molesting eight boys, some he may end up facing in court next week. >>> a berkeley high school counselor who allegedly asked a female student if she slept naked will still be allowed to work on campus but has to keep the door to his office open in a lawsuit filed by the mother of the girl, anthony smith was accused of touching and making inappropriate remarks to female students. the school district will pay more than $57,000 to the girl to settle the lawsuit. the girl has been assigned another counselor but smith will still be allowed to counsel other girls on campus. >>> today the debate continues surrounding california's cont

't anybody at penn state act to stop accused child molester jerry sandusky? as students celebrated graduation from penn state over the weekend, key players in the school's sex abuse scandal gear up to go to trial. on friday, penn state assistant coach and star witness mike mcqueary took the stand and graphically described seeing a naked jerry sandusky engaged in what he called extreme sexual activity with a young boy. it was march 2002 when mcqueary, then a graduate assistant, went to the penn state locker room near the shower area. "the boy was up against the wall, jerry was directly behind him in a very, very close position. i believe jerry was sexually molesting him." mcqueary's testimony is key to the case against two former penn state officials, athletic director tim kucurley and senio vice president gary schultz, both failing to report it to authorities. >> i think it's a sad, sad, sad day when you think about all of these victims, and you just got your first taste of it. >> reporter: prosecutors also read from former coach joe paterno's grand jury testimony. he told the panel an upset
